1. Acceptance of Terms
By accessing and using Avertex ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Description of Service
The Service is operated by Avertex Limited, 74 Central Cross Apartments, 2 Southend, Croydon, United Kingdom ("we", "us", or "our"). Avertex helps self-managed landlords stay on top of properties, tenants, maintenance requests, documents, and communications. The Service is provided "as is" and we reserve the right to modify or discontinue features at any time.
3. User Accounts
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the security of your account credentials.
- You must notify us immediately of any unauthorized access to your account.
- You must be at least 18 years old to use this Service.
4. User Responsibilities
As a user of Avertex, you agree to:
- Use the Service only for lawful purposes and in compliance with applicable laws.
- Not upload any content that is illegal, harmful, threatening, or violates third-party rights.
- Not attempt to gain unauthorized access to any part of the Service.
- Not use the Service to send spam or unsolicited communications.
- Maintain accurate records of your properties and tenancies.
5. Landlord-Tenant Relationships
Avertex is a tool to facilitate property management but does not participate in or guarantee any landlord-tenant relationships. Users are responsible for ensuring their use of the platform complies with all applicable housing laws and regulations.
6. Data and Content
- You retain ownership of any content you upload to the Service.
- You grant us a license to store and process your content to provide the Service.
- You are responsible for backing up your own data.
- We may remove content that violates these terms without notice.
7. Subscription, Billing and Cancellation
- Paid plans are billed in advance on a recurring basis (monthly or annually) through our payment processor, Stripe.
- Subscriptions renew automatically at the end of each billing period until cancelled.
- You can cancel at any time from your billing settings. Cancellation takes effect at the end of the current paid period, and you retain access until then.
- Except where required by law, payments are non-refundable and we do not provide pro-rata refunds for partial periods.
- Nothing in this section affects any statutory cancellation or refund rights you may have as a consumer under UK law.
- We may change plan pricing or features; we will give reasonable notice of material changes before they take effect.
8. Limitation of Liability
To the maximum extent permitted by law, Avertex shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities arising from your use of the Service.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.
9. Termination
We reserve the right to suspend or terminate your access to the Service at any time for violations of these terms or for any other reason at our discretion. Upon termination, your right to use the Service will immediately cease.
10. Changes to Terms
We may update these Terms of Service from time to time. We will notify users of significant changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
